My RV-12 flagged by FAA for ADS-B Out failed compliance...

.... But I don't have ADSB-Out installed! I just have a Skyview connected to a Trig TT22 Mode S Transponder.
I received a certified mail from the Flight Standards Service notifying me that I have 45 days to correct the equipment.
They mentioned that in case of non compliance after this delay my plane would be entered in a No Service Aircraft List (NSAL). This would result in the loss of ADS-B based ATC service and Traffic Information Services-Broadcast (TIS-B). They gave me a record of the last flight which had happened just one day after my Biennial Inspection of the Transponder which passed with success. I immediately suspected the inspection to be the culprit but a checking with the Avionics company which made the inspection did not find anything abnormal. I contacted the Aviation Safety Inspector mentioning all this and that I don't have ADS-B installed but he insisted that I was broadcasting non compliant ADS-B Out information. This time he gave me a record of all flights I made since January 1st showing the red flag on the SIL and SDA parameters. I believe that the TIS function that is (was?) provided by Skyview before the introduction of the ADS-B service is the cause of this problem because the GPS that came with the Skyview is not ADS-B compliant. Please, Dynon, let me know how to get out of this situation if I don't want to install ADS-B while still keeping the TIS feature which I like.

Do you have a standalone Trig TT22 Mode S Transponder? If so, I think that not having a GPS connected will inhibit ADS-B Out. But you'll want to check with them. But, if this is actually an SV-XPNDR-261, the ADS-B Out functionality is built in and turned on by default. As of SkyView v16, it can be turned off by setting the GPS position source in the transponder setup menu to none.

However, for those that ARE equipped (ie, have an SV-XPNDR-261 + either an SV-GPS-2020 or other IFR-based source), note that you're actually not allowed to do this. You have to operate it at all times (see 91.225)

From the TT22 install manual:

"8.8 ADS-B Monitor
The ADS-B Monitor is only available on installations that include an ADS-B position source. The ADS-B Monitor provides a display of the position information that is being transmitted in ADS-B position reports. This can provide confirmation that the correct information is being transmitted, particularly where the GPS source is remote from the transponder. In the event that valid position information is NOT available from the GPS, the latitude and longitude display will be replaced by dashes; if no valid latitude and longitude is shown then ADS-B position information is NOT being transmitted."

So you should be able to check this to see if the transponder is broadcasting ADS-B by looking at the ADS-B Monitor function on the transponder. The text also makes it seem the above post is correct in that it should not broadcast without a GPS position source connected (pin 5 on the TT22 connector).
